Beintoo Identifiers Policy

The company Beintoo S.p.A., having its registered office in Via Paleocapa n.3, 20123 – Milan (Italy), VAT No. 07295690965 (hereinafter, “Beintoo”), provides data subjects (hereinafter, “Users” or “You”), with the following privacy policy (hereinafter, the “Identifiers Policy”) pursuant to Italian Legislative Decree 196/2003, as amended and supplemented (hereinafter, the “Privacy Code”) and pursuant to Article 13 of EU Regulation 2016/679 of 27 April 2016 (hereinafter, “Regulation”; the Regulation together with the Privacy Code, “Applicable Law”).
Beintoo is a mobile data company that focuses on the collection and use of personal data, including location data, as further specified below, in order to assist advertisers in delivering more accurate offers to Users.
In providing its services (the “Service”), as further described below, Beintoo acts as a third party in relation to the website and/or mobile version of the website and/or mobile application from which you are coming from (the “Data Source”) and may collect personal data from your desktop computer, laptop, mobile phone, tablet, or other electronic device used to access the Data Source (each a “Device”).
Since our Service use cookie and/or they may use other further identifiers (such as pixel, tag or SDK), for several purposes, we hereby aim at explaining to you what cookies are and how they are used.
Certain cookies are conveyed and controlled by us directly. Other cookies, however, are conveyed and controlled by third party. In this Identifier Policy, you will find links to the information published by these third parties, which we suggest you read carefully.
In certain cases, Beintoo makes use of proprietary technologies that perform a management and technical support function for the provision and operation of cookie and/or other identifiers.
In this Identifiers Policy, any time you will find the word “cookie” this may refer also to other identifiers (such as pixel, SDK and similar technologies). In the latter case, Beintoo will specify these technologies, if different than cookies.
- What are cookies and what they are for
Cookie are small text files that the website visited by a user send directly to its terminal (usually, to the browser) for storage, where they are then recognized by the same website during the same user’s subsequent visit (the so-called first part cookies). During the web surfing of the website, a user may also receive on its terminal cookie of other website (the so-called third-party cookies).
Cookies are used for several purposes. Certain cookies are necessary in order to allow you to surf the website and benefit of its functionalities (the so-called technical cookie). Other cookies are used in order to obtain statistical information, whether in aggregate or not, about the number of users accessing the website and how the website is used (the so-called monitoring cookies or analytics). Other cookies are used in order to track your consumer profile and display tailored advertising that may be of the interest for you, according to your preferences and your consumer habit (the so-called profiling cookie).

- Monitoring or analytics cookies
The analytics cookies are used in order to collect statistical information, whether on aggregate or not, on the number of users accessing a service.
The following analytics cookies are installed with your prior consent, since the same are not anonymized, given that third parties can access to analytics disaggregated data at the IP addressed level (in other word, using these cookies, third parties could theoretically go back to your identity by means of the IP address):

As your prior consent is required for the installation of such analytics cookies, when you access to the Data Source a specific banner or so-called Consent Management Platform (CMP) is displayed, informing you that non-technical cookies are used on the Data Source and that, by clicking the relevant button provided therein, you may consent to their use. In this way, the publisher of the Data Source will not display the cookie banner or the CMP during your subsequent visits to the Data Source. Please note that, should you remove such technical cookie from your browser in accordance with the procedure set out in paragraph E (1) below, record of your consent will be lost and, accordingly, the cookie banner will reappear upon your subsequent visit to the Data Source.
You are clearly free to block the installation of analytics cookies in any moment whatsoever and this will not compromise in any manner whatsoever the possibility to visit the Data Source and benefit of its contents.
- Profiling cookies and/or other identifiers (both referred to as “Profiling Cookies”)
The Profiling Cookies are used to create a user’s profile, based on the preferences and likings showed by you during the navigation on the Internet and to make you display advertisings consistent with your profile. This is done to show you advertising that is more tailored and relevant to your interests.
Your prior consent is requested in order to install such Profiling Cookies, as provided pursuant to the Applicable Law. For such reason, when you access the Data Source a specific banner or so-called Consent Management Platform (CMP) is displayed, informing you that cookies that do not serve technical purposes are used on the Data Source and that by pressing the proper button provided therein, you may agree to their use. - Processing purposes
If You give us your prior consent, when You access or use a Data Source, the publisher of that Data Source may allow us to automatically collect data relating to your Device and your activity and interaction with such Data Source, which do not directly identify You and which, depending on the Device, may include:
- IP address;
- data relating to the HTTP protocol (e.g. visited web address or URL);
- unique Device identifiers for advertising (Google Advertising ID, so-called GAID, or the Identifier for Advertisers, so- called IDFA);
- information relating to your interactions with the advertising campaign (e.g. clicks, percentage of completion of the viewing of the advertising video);
- geolocation and proximity of your Device to specific geographic points pre-selected by Beintoo, if location service are enabled on your Device);
- information and events relating to your Device, as system activities and hardware settings (e.g. developer of your Device);
- system configuration Data (e.g. battery, system version);
- information on time and date.
We will use your personal data and information relating to your Device for the following purpose:
- marketing and profiling activities to display advertisements and offers tailored to your performances and consumer habits, including through the creation and/or allocation of User segments based on your preferences and browsing habits;
- assigning Users’ visit to stores or other specific place of interest for advertising campaigns;
- developing and using models to predicts Users’ potential future behaviour and interests based on the Device and across Device. In particular, we use the collected data to make interferences about activities in which the User tend to spend more time. For example, we may observe that a specific Device is frequently located in places associated with the purchase of cars (e.g. dealership), clothing (e.g. a shopping mall or outlet), places to eat out (e.g. restaurants), or to attend shows (e.g. cinemas) and formulate hypotheses about which advertising content may be of greater interest to the User of that Device, in order to assign such User to a particular segment of Users;
- assisting advertisers in delivering non-intrusive advertising;
- assisting advertising in analysing advertising effectiveness (e.g. the engagement of a specific Device with a specific advertisement);
- conducting internal analyses and improving ad optimizing our Services;
- verifying and maintaining the security of our Services.
In no case we will use the personal data collected directly by Beintoo’s technologies or by any third parties, in order to determine the user’s identity or the user’s current position.
We will further use your personal data for the creation of a unique ID for retargeting purposes. By means of the creation of a unique ID, Beintoo may track and target your habits, and recognize you at each visit to the Data Source. In some cases, Beintoo may memorize the IP addresses exclusively to extract geographical or statistical information (we may carry out the same above-mentioned activities also using the ID collected through mobile applications).
Beintoo may also be able to connect multiple devices used by a single user into a single, anonymous user profile: this may be carried out through an ID (which is not able to identify you) used on different Devices. This lets us offer our services on different Devices, even if we are not able to identify you directly: we do not have (and we will not be involved in) any contractual relationship with third services providers able to identify Users.
Moreover, using the aforementioned tracking technologies, Beintoo is able to show You personalized ads related to your prior visit to a Data Source. So, for example, if the User visits “website A” relating to “beauty” and “make-up products”, on a subsequent access to “website B” (or “mobile application C”) the user will interact with an ad relating to “make-up products”, that is personalized based on his/her previous visit to the “website A”.
In addition to the purposes set out above, we may share the data we collected, as well as our statistical data, as follow:
- with publisher and advertiser for market research, statistical analyses, or traffic pattern analyses;
- with the other third party, such as demand side platform (DSP), advertising platforms, data management platform (DMP), advertising agency trading desks, proximity solution provider, and advertising technology provider, so that they may provide You with targeted content and advertising on third-party websites, mobile applications, and other advertising channels, and so that they may measure the effectiveness of advertisements through the types of “attribution” referred to above.
In certain cases, we may provide data (such as the IP address, but excluding precise lat./long. coordinates) to third party platforms connected to the relevant segments in order to assist advertisers in identifying common Users across different Device or browsers – for example, to identify a common group of Users across mobile and tablet devices as well as on the web.
Finally, we may be required to disclose personal data in response to lawful requests from public authorities. We may also disclose your personal data where required by applicable law, for example to comply with a subpoena or other legal process, when we believe in good faith that such disclosure is necessary to protect our rights, your safety or the safe of others, to investigate fraud, or in connection with a merger acquisition, or other extraordinary corporate transaction.

- Modify the settings of the Device or of the mobile application
When we collect location information (generally speaking, lat./long. coordinates greater than two decimal places) from mobile of our publishers, we endeavour to work with partners that provide their users with information regarding the use of mobile data for interest-based advertising purposes and consumer’s opt out rights.
You may manage certain collection and sharing data in connection with our Services as follows.
You may limit the disclosure of certain personal data by your mobile Device to us and publishers by adjusting the settings on your mobile Device:
- for IOS mobile Devices, go to “Settings” from your Device’s home screen; scroll down to “Privacy”; select “Advertising”; and turn on “Limit Ad Tracking”.
- for Android mobile Devices, go to “Google Settings” on your Device; select “Ads”; and check the box labelled “Opt Out of Interest-Based Ads”. We comply with these “limit” or “opt out” or “choices” instructions by removing the Devices recognised by our in-app advertising or ad delivery and reporting solutions, directly. (We may continue to use data from this Devices for other purposes, such as market research and aggregated customer analytics, but we will not use this information for interest-based advertising purposes).
Publisher and advertiser may also provide ways for You to opt out from or limit their collection of data from and about You. Please refer to the privacy policies for the individual mobile applications to learn more about the privacy practices of publishers and advertisers. Please note, however, that we are not responsible for the privacy practices of publisher, advertiser and other third parties.
- Other information
As highlighted under the preamble of this Identifiers Policy, the Company collects and processes certain personal information by means of the cookies conveyed directly by Beintoo. The Company acts as data controller of such data, in compliance with the provisions of the Applicable Law.
As indicated in the previous paragraph D, Beintoo will collect your personal data only after You give your prior consent to the use of cookies.
Beintoo takes the utmost account to the privacy rights and the protection of its Users’ personal information. For that and other reasons, Beintoo is part of the Transparency & Consent Framework of IAB Europe. Users may find more information here: https://iabeurope.eu/transparency-consent-framework/. In particular, Beintoo participates in the IAB Europe GDPR Transparency & Consent Framework and complies with its Specifications and Policies. Beintoo’s identification number within the framework is 618.
Please note that we will process your data with electronic instruments only, in a much-automatized manner and without any human intermediation. Therefore, our employees and co-workers will never access the content of your personal information obtained by means of cookies, meaning that they will never be able to see and/or have any direct PII (Personally Identifiable Information) that is information from which it will be possible to identify you directly.
Some of our employees and co-workers, appointed by us to process data, could make maintenance operations on IT systems that host your data, without the possibility to access their actual contents. The personal data could be memorized on servers managed by third parties (for example, providers of IT systems) or may be managed by online marketing specialized subjects, acting as data processors on the basis of specific written appointments by the Company.
We hereby inform you that, complying with the requirements and the guarantees provided under the law, your data could be transferred to Countries outside the European Union that could not guarantee a level of privacy and personal data protection equal to the level of protection guaranteed by the Italian and European privacy laws. Where we act as Data Controller, we take the utmost account of the right to security and protection of personal data of our Users, therefore we will process such transfers with all due care and guarantees.
Your personal data will not be disseminated.
Security and Retention. The security of your personal information is of paramount importance to us. We follow generally accepted standards to protect the personal information submitted to us, both during transmission and once it is received. If you have any questions about the security of your personal information, you can contact us at addresses reported in paragraph G.
We retain the information we collect from Data Source for up to 24 months or as needed to comply with our legal obligations, resolve disputes and enforce our agreements.
Changes to this Identifiers Policy. We may update this Identifiers Policy to reflect changes to our data practices. If we make any material changes, we will notify You by means of a notice on this website prior to the change becoming effective. We encourage You to periodically review this page for the latest information on our privacy practices.

- the right to object:
- in whole or in part, on legitimate grounds to the processing of personal data concerning him/her, even though they are relevant to the purpose of the collection;
- in whole or in part, on the processing of personal data concerning him/her, where it is carried out for the purpose of sending advertising materials or direct selling or else for the performance of market or commercial communication surveys;
- if they believe that the processing that concerns them violates any Applicable Law, the right to lodge a complaint with a Supervisory Authority (in the Member State in which they usually reside, in the one in which they work or in the one in which the alleged violation has occurred).
